CODE OF ACADEMIC INTEGRITY AND CORPORATE ETHICS OF BOHDAN KHMELNYTSKY CHERKASK NATIONAL UNIVERSITY

1. GENERAL PROVISIONS

 

1.1. The Code of Academic Integrity of Bohdan Khmelnytskyi Cherkasy National University (hereinafter - the Code) establishes the rules of ethical behavior between participants in the educational process during learning, teaching and carrying out scientific (creative) activities.

 

1.2. This Code was developed on the basis of the Constitution of Ukraine, the Civil Code of Ukraine, laws of Ukraine "On education", "On higher education", "On scientific and scientific and technical activities", "On copyright and related rights", "On publishing", "On Prevention of Corruption", Statute of Bohdan Khmelnytskyi Cherkasy National University, Rules of Internal Procedure, Collective Agreement, etc.

 

1.3. The purpose of the Code is to maintain high professional standards in the activities of the Bohdan Khmelnytskyi Cherkasy National University (hereinafter - the University), support democratic relations between scientific and pedagogical workers and students of higher education, prevent academic dishonesty, observe corporate culture and create a favorable moral and psychological climate in team

 

1.4. Scientific and pedagogical workers and students of higher education, aware of their responsibility for the proper performance of functional duties, for the formation of a favorable academic environment to ensure the effective organization of the educational process, the development of the intellectual and personal potential of the University, undertake to comply with the norms of the Code.

 

1.5. Tasks of the Code:

- to adapt the system of traditional corporate guidelines of the national educational system and academic science to modern realities in order to ensure and maintain a favorable moral climate in the team, establish and observe ethical norms and rules;

- to ensure the establishment of norms of ethical behavior both within the team and in the external environment;

- to support and nurture the corporate movement, an atmosphere of trust, mutual respect and decency.

 

2. PRINCIPLES OF ACADEMIC INTEGRITY AND CORPORATE ETHICS

 

2.1. Academic integrity is a set of ethical principles and rules defined by law that must be followed by participants in the educational process during learning, teaching and carrying out scientific (creative) activities in order to ensure trust in the results of studies and/or scientific (creative) achievements.

 

2.2. Academic integrity and corporate ethics are implemented at the University by following the following principles:

- legality;

- honesty;

- mutual respect;

- tender equality;

- politeness;

- justice;

- responsibility;

- transparency;

- tolerance;

- democracy;

- rule of law;

- the priority of human and citizen rights and freedoms;

- equality;

- guarantee of rights and freedoms;

- science;

- professionalism and competence;

- respect and mutual trust;

- responsibility for violation of academic integrity.

 

2.3. Every employee and participant in the educational process of the University has the right to freely choose their civil and scientific position, to declare it openly when discussing decisions and internal documents. In case of disagreement with the University's Development Strategy (hereinafter - the Strategy), its goals, etc., a person has the right to defend his chosen position only on his own behalf. A person entrusted with administrative and managerial functions must avoid public statements that negatively affect the image of the University.

 

2.4. Official coverage of the activities of the University and directions of its development, implementation of the Strategy may be carried out by the rector of the University or a person on his behalf.

 

2.5. In case of dissemination of false information with misrepresentation of facts, offensive to a person, or such that can cause serious damage to the University, the person involved in this must do everything possible to refute the false information and reduce the amount of moral damage caused.

 

2.6. The university conducts its activities independently of political parties, religious associations and movements. The University does not pay any dues to political parties, does not support any political party and does not promote political slogans of any political force.

 

2.7. Employees and participants in the educational process of the University must avoid provoking actions related to corruption offenses. In order to stop and avoid such manifestations, all persons subject to the validity of this Code have the right to contact the relevant authorities.

 

2.8. The rector of the University is obliged to take care of the protection of moral and ethical norms and principles, personal dignity, sufficient material support and social protection, creation of proper conditions for carrying out professional activities, improvement of professional qualifications of subordinates. Rector's decisions must be impartial.

 

2.9. The University's administration should be understanding of the diversity of political, religious, philosophical views and opinions of participants in the educational process and employees, create conditions for the exchange of views, etc. Different statuses of scientific and pedagogical workers, qualification categories and duties should not prevent all scientific and pedagogical workers, scientists from expressing their opinions and defending their beliefs on an equal basis. The administration does not have the right to collect information about the personal life of scientific and pedagogical workers, scientists, that is not related to their performance of their work duties.

 

3. OBSERVANCE OF ACADEMIC INTEGRITY

 

3.1. Observance of academic integrity by scientific and pedagogical workers involves:

- references to sources of information when using borrowed ideas, developments, statements, information;

- compliance with the norms of current legislation on copyright and related rights;

- provision of reliable information about research methods and results, sources of used information and own scientific (scientific-pedagogical, creative) activity;

- control over compliance with academic integrity by education seekers;

- objective evaluation of learning results.

 

3.2. Observance of academic integrity by students of higher education involves:

- independent performance of educational tasks, tasks of current and final control of learning results (for persons with special educational needs, this requirement is applied taking into account their individual needs and capabilities);

- references to sources of information when using borrowed ideas, developments, statements, information;

- compliance with the norms of current legislation on copyright and related rights;

- provision of reliable information about the results of one's own educational (scientific, creative) activities, used research methods and sources of information.

 

3.3. Violation of academic integrity is considered:

- academic plagiarism - publicizing (in part or in full) scientific (creative) results obtained by other persons as the results of one's own research (creativity) and/or reproduction of published texts (publicized works of art) of other authors without indicating authorship;

- self-plagiarism - publicizing (partially or completely) one's own previously published scientific results as new scientific results;

- fabrication - fabrication of data or facts used in the educational process or scientific research;

- falsification - deliberate change or modification of already available data related to the educational process or scientific research;

- writing off - performance of written works involving external sources of information other than those permitted for use, in particular during the evaluation of learning outcomes;

- deception - provision of knowingly false information about one's own educational (scientific, creative) activity or organization of the educational process; forms of cheating are, in particular, academic plagiarism, self-plagiarism, fabrication, falsification and plagiarism;

- bribery - providing (receiving) by a participant in the educational process or offering to provide (receiving) funds, property, services, benefits or any other benefits of a material or non-material nature in order to obtain an unlawful advantage in the educational process;

- biased assessment - deliberate overestimation or underestimation of the learning outcomes of education seekers.

 

3.4. For violation of academic integrity, pedagogical, scientific-pedagogical and scientific employees of the university may be held to the following academic responsibility:

- refusal to award a scientific degree or assign a scientific title;

- refusal to assign or deprivation of the assigned pedagogical rank, qualification category;

- deprivation of the right to participate in the work of bodies defined by law or to hold positions defined by law.

 

3.5. For violations of academic integrity, students may be held to the following academic responsibility:

- repeated assessment (test, exam, credit, etc.);

- repeated passage of the relevant educational component of the educational program;

- deprivation of an academic scholarship.

 

4. COMPLIANCE WITH CORPORATE ETHICS

 

4.1. Observance of corporate ethics by pedagogical, scientific-pedagogical and scientific workers involves:

- implementation of the rules of ethical behavior;

- a responsible attitude towards the performance of one's duties;

- promoting a positive image of the University;

- establishment of partnership relations between the participants of the educational process;

- implementation of students' right to acquire knowledge, necessary professional skills and abilities;

- the teacher's choice of such work methods that will encourage students to develop positive qualities and relationships: independence, self-control, self-education, the ability to work in a team, cooperate, help others, etc.;

- development of students' communicative competence;

- respect for psychophysical and spiritual values of students, their moral ideals, honor and dignity, etc.;

- ensuring the opportunity to realize the right of students to freely express their opinions and positions in the process of educational activities;

- respect for the right of students to freely choose a teacher for themselves;

- confidentiality of information;

- establishing relations of mutual cooperation and co-creation with the student;

- avoiding ambiguous relationships with students to prevent conflicts related to the non-academic nature of the relationship;

- referring to "You" to applicants of higher education;

- refraining from discussing the professional and personal qualities of colleagues and students of higher education;

- refraining from any statements or actions that undermine respect for the chosen profession;

- a ban on spreading political, religious agitation or propaganda during working hours, inciting colleagues to actions and deeds incompatible with the title of teacher;

- not to disclose the use of confidential information with limited access or personal information that became known in connection with the performance of official and professional powers in another way;

- establishing relations with colleagues based on the principles of respect, mutual support, openness and trust, willingness to share professional knowledge and experience;

- avoidance of competition that interferes with the execution of a joint task;

- avoiding conflicts in relationships;

- responsible, economical and appropriate use of the University's infrastructure;

- in case of differences of opinion, striving for their constructive solution;

 

4.2. Observance of corporate ethics by students of education involves:

- compliance with the principles of academic integrity;

- increasing the prestige of the University through its own achievements in education, science, sports, creativity, etc.;

- honoring the history of the University, the achievements of its employees;

- promoting the positive reputation of the University through all types of cognitive activities;

- a ban on offering gifts, bribes to obtain any advantages in educational activities;

- address "You" to the teacher;

- punctual attendance of classes;

- polite communication;

- promotion of prevention and eradication of various types of violations of laws and norms of corporate ethics, etc.

 

4.3. Receiving and giving gifts:

It is forbidden to directly or through other persons demand, request, receive gifts for oneself or loved ones from legal entities or individuals. Pedagogical, scientific-pedagogical and scientific workers, the rector of the University may accept gifts that correspond to generally accepted notions of hospitality (for example, gifts in the form of souvenirs, treats with food and drinks, invitations to entertainment events, reimbursement of transportation expenses and hotel accommodation), in in cases where the value of such gifts does not exceed one minimum wage established on the day of acceptance of the gift, once, and the total value of such gifts received from one source during the year does not exceed two subsistence minimums established for an able-bodied person on January 1 of the current year. The limit on the value of gifts does not apply to gifts that:

- given by relatives;

- received as publicly available discounts on goods, services, publicly available winnings, prizes, bonuses, bonuses.

In the event that a University employee makes a decision in favor of the person from whom he or his relatives received a gift, the employee's decision is considered to have been made in the context of a conflict of interest.

Gifts received by the rector of the University or employees, as gifts of the University, are accordingly state property and are transferred to the University in accordance with the procedure determined by the Cabinet of Ministers of Ukraine.

Pedagogical, scientific-pedagogical and scientific employees of the University, in the event that they receive an offer of undue benefit or a gift, regardless of private interests, are obliged to immediately refuse the offer; if possible, identify the person who made the offer; attract witnesses, if possible, including from among employees; to inform in writing about the proposal of the immediate supervisor.

An act is drawn up on the discovery of property that may be an illegal benefit or a gift, which is signed by the person who discovered the illegal benefit or gift and the rector of the University.

In the event that the University rector discovers property that may be an illegal benefit or a gift, the act of discovery of such property is signed by the University rector or a person authorized to perform the duties of the University rector in his absence.

Pedagogical, scientific-pedagogical and scientific workers, the rector, as well as persons acting on behalf of the University, refrain from offering gifts to civil servants, people's deputies of Ukraine, deputies of local councils, their relatives, actual or potential business partners, their employees or representatives , as well as from any other behavior that can be considered as readiness to commit a corruption offense related to the activities of the University.

The general policy of the University regarding the offering of gifts on behalf of the University within the framework of generally accepted notions of hospitality is determined by the rector, taking into account the requirements of the law.

 

4.4. Conflict of interest:

Pedagogical, scientific-pedagogical and scientific employees of the University are obliged not later than the next working day from the date when they learned or should have learned about the existence of a real or potential conflict of interests, to notify the rector in writing, not to take actions and not to make decisions in conditions of real conflict of interest and take measures to resolve the actual or potential conflict of interest.

The rector, within two working days after receiving a notification that a subordinate has a real or potential conflict of interest, makes a decision on how to resolve the conflict of interest, and informs the employee about it. The rector is obliged to take the measures prescribed by law to prevent and resolve conflicts of interest (including in the case of independent detection of an existing conflict of interests in a person subordinate to him without making the relevant notification).

The decision on the settlement of the conflict of interests in the activity of the rector of the University is taken by the Ministry of Education and Science of Ukraine.

 

5. COMMISSION ON MATTERS OF ACADEMIC BENEVOLENCE AND

CORPORATE ETHICS

 

5.1. The Commission on Academic Integrity and Corporate Ethics at the University (hereinafter referred to as the Commission) is an independent body that operates at the University to ensure monitoring of compliance by University community employees with academic integrity and moral and ethical norms of the Code. The composition, powers and activities of the Commission are determined by the relevant Regulations.

 

5.2. The commission is a collegial body. The composition of the commission is elected by the labor collective conference for a period of 2 years. The Commission includes representatives from educational and scientific institutes, faculties, the Council of Young Scientists, students of higher education, and the trade union committee.

 

5.3. If necessary, lawyers may be involved in the work of the Commission.

 

5.4. The Regulation on the Commission is reviewed and approved by the academic council of the University.

 

6. FINAL PROVISIONS

 

6.1. Employees, participants in the educational process of the University should know the Code of Academic Integrity and Corporate Ethics at Bohdan Khmelnytskyi Cherkasy National University. Ignorance or misunderstanding of the Code is not an excuse for unethical behavior. The University provides public access to the Code through its own official website.

The requirements of the Code are mandatory for all pedagogic, scientific-pedagogical, scientific workers from the moment of their appointment to the position and higher education seekers from the moment of their admission to the University.

 

6.2. The code of academic integrity and corporate ethics at the University is approved by the conference of the labor team and put into effect by the order of the rector.

 

6.3. In case of violation of the Code by teaching, research and teaching staff, and higher education students, the methods of influence provided for by the current legislation may be applied to the guilty persons.

6.4. Changes and additions to the Code can be proposed by employees, participants in the educational process, considered and adopted at the Conference of the labor team.
